Kerry betting shop gets permission for change of use to restaurant and takeaway

The planning authority said the request does not impact layout of local area.

An Bord Pleanála has granted permission for change of use from a betting shop to a restaurant, deli, and takeaway in Kenmare.

The development is located on the ground floor of a two-storey corner building at the north eastern end of Market Street in the town.

Planning was granted by Kerry County Council in February 2023, which was subsequently appealed to An Bord Pleanála.

Submissions against the development initially cited noise pollution from the kitchen area that would ‘intrude’ on a residential area, and concerns over a metal chimney flue that posed a risk from lightening and an enhanced fire risk.

Change in traffic routes and smoke from a chimney flue entering nearby homes were listed as other possible health and safety issues.

But An Bord Pleanála granted planning subject to six conditions. This includes the restaurant only operating between 10am and 10pm. A skylight in the kitchen is to be permanently closed, while retention of a chimney flue on the flat roof was refused planning.

It was decided the shopfront signage of the new restaurant would not ‘injure’ the visual and residential amenities of the area. The owner was ordered to complete the proposed new shopfront within three months as of April 10, 2024.
